Privacy Policy

Evolve Hyperbarics is committed to protecting the privacy of the personal health information (PHI) of our patients, the personal information of website visitors, and the information shared with us by referring physicians. This policy explains what information we collect, how we use and protect it, and the rights you have.

We comply with the Personal Health Information Protection Act, 2004 (PHIPA) of Ontario and the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada.

Who We Are

In this policy, “Evolve,” “we,” or “our” means Evolve Hyperbarics and the affiliated clinical entities operating each of our clinic locations. The Health Information Custodian under PHIPA for each clinic is the physician responsible for that clinic, with the network Medical Director (Dr. Seema Agarwal) as the network privacy officer.

What Personal Information We Collect

From Patients

  • Demographic information (name, contact details, date of birth, OHIP / health card number where applicable)
  • Health information: diagnosis, medical history, current medications, imaging, lab results, prior treatment records
  • Information collected during consultation and treatment sessions
  • Records of consent, billing, and correspondence

From Website Visitors

  • Information submitted through the Check Eligibility form
  • Limited analytics data: pages visited, anonymized location, referring source — used only to improve site usability
  • No third-party advertising trackers; no cookies beyond what is necessary for site function

From Referring Physicians

  • Physician name, CPSO number, contact details, and clinic affiliation
  • Patient referral documentation
  • Correspondence related to ongoing patient care

How We Use Personal Information

  • To provide medical care, including consultation, treatment, and follow-up
  • To bill OHIP, WSIB, private insurance, or the patient directly for services rendered
  • To communicate with referring physicians about your care
  • To meet legal, regulatory, and accreditation obligations
  • To improve our services through internal quality review and audit (de-identified where possible)
  • To respond to inquiries submitted through our website or by phone, fax, or email

How We Protect Your Information

  • Electronic records are stored in encrypted systems with access controls and audit logs
  • Paper records, where they exist, are stored in locked cabinets in secured areas
  • Access to personal health information is limited to clinical and administrative staff who require it to perform their duties
  • All staff sign confidentiality agreements and complete privacy training annually
  • Information transmitted over public networks (e.g., email) is encrypted or otherwise secured where it contains PHI
  • Privacy and security incidents are documented and managed per PHIPA breach notification requirements

Sharing Personal Information

We share personal health information only with:

  • Members of the patient’s circle of care (e.g., referring physician, consulting specialists, primary care provider)
  • Funding bodies as required for billing (OHIP, WSIB, private insurer at patient’s direction)
  • Regulators, accreditation bodies, or law enforcement where required by law
  • Service providers who help us operate (e.g., secure IT hosting, document destruction), bound by written agreements requiring equivalent privacy protections

We do not sell personal information. We do not share personal information with advertisers, marketers, or third parties for purposes unrelated to your care.

Your Rights

  • You have the right to access your personal health information held by Evolve
  • You have the right to request corrections to records you believe are inaccurate
  • You have the right to withdraw consent for certain uses of your information (subject to legal exceptions)
  • You have the right to receive a copy of your records (subject to a reasonable cost-recovery fee, where applicable)
  • You have the right to complain to the Information and Privacy Commissioner of Ontario (IPC) if you believe your privacy rights have been breached

Retention and Destruction

Patient records are retained per the requirements of the Medicine Act and the College of Physicians and Surgeons of Ontario. In general, adult patient records are retained for at least 10 years from the date of the last interaction; pediatric records are retained until the patient reaches age 28 or for 10 years from the last interaction, whichever is later. Records are securely destroyed at the end of the retention period.

Changes to This Policy

This privacy policy may be updated from time to time. Material changes will be communicated through the Evolve website and, where appropriate, in writing to active patients.
